Services Provided
Thomas Fence provides professional fence installation services, including vinyl, wood, chain link, ornamental steel, farm fencing, temporary fencing, and gate installation/automation.
All services are limited strictly to the scope outlined in the written estimate or contract. No services are provided beyond what is explicitly stated in writing.
Scope of Work
Unless otherwise specified in writing, services include installation of fencing using standard materials and methods, along with basic site cleanup.
The following are not included unless explicitly stated in writing:
- Permit acquisition or approvals
- Property line verification or surveying
- Land grading or leveling
- Removal of underground obstructions (rocks, roots, etc.)
- Utility locating services
Estimates & Pricing
All estimates are based on initial site evaluations and may change due to unforeseen conditions, including soil conditions, terrain, hidden obstructions, or customer-requested modifications.
Payments
- No deposit is required for standard residential installations
- Deposits may be required for special-order materials or custom metal work
- Credit card payments are subject to a 3.5% processing fee
- Financing may be offered through third-party providers (such as Hearth). Thomas Fence is not a lender and is not responsible for financing approvals, terms, or agreements.
Scheduling & Delays
Project timelines are estimates only and may be affected by weather, material availability, and site conditions. Completion dates are not guaranteed.
Permits & Approvals
Customers are responsible for obtaining all required permits, approvals, and verifying property boundaries.
Thomas Fence may provide guidance but assumes no responsibility for permit acquisition unless explicitly agreed to in writing.
Change Orders
Any work outside the agreed scope must be approved in writing and may result in additional charges.
Warranty
Thomas Fence provides a 1-year workmanship warranty covering installation quality only.
Certain materials (such as ornamental steel) may include a manufacturer-provided warranty, including lifetime residential warranties where applicable. These warranties are provided solely by the manufacturer and are subject to their terms, conditions, and limitations.
Thomas Fence does not provide or extend manufacturer warranties.
Third-Party Services Disclaimer
Thomas Fence may refer or facilitate access to third-party services, including financing providers and product manufacturers.
Thomas Fence is not responsible for:
- Financing approvals, terms, or agreements offered by third-party lenders
- Manufacturer warranties or product performance beyond installation
- Any agreements entered into between the customer and third parties
All third-party services are subject to their own terms and conditions.
Limitation of Liability
Thomas Fence is not responsible for:
- Damage caused by unknown or undisclosed underground conditions
- Soil movement, weather conditions, or natural wear and tear
- Customer failure to maintain installed fencing
- Third-party modifications after installation
To the fullest extent permitted by law, Thomas Fence's liability is limited to the amount paid for the services provided.
Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to services provided by Thomas Fence shall be resolved through binding arbitration conducted in the State of Arkansas, except where prohibited by law.
Both parties waive the right to a trial by jury.
Class Action Waiver
To the fullest extent permitted by law, any claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Arkansas.
